You need to call the Zoning administrator in your city and ask. I know in my town you are allowed to put a stone patio in without a permit if it is under a certain size and so far away from your neighbors land. The next town over has a totally different approach to zoning. They practically regular what you can plant for flowers.

rule of thumb , if it can be seen , get a permit. when applying , they will explain what and how along with inspection requirements. of course , you can build and if caught probably pay a minimal fee, but worse case , could make you remove and start again.
