That would depend on what species. The Lasius niger which is commonly found in many horticultural environments is protected under UN legislation and prosecution may be incurred if unlawful extermination is deemed to have been perpetrated.
LOL, jokes. It's completely legal, but it's not nice to go out of your way to kill them. If they're causing a problem by infesting your house then it makes sense to kill them. But destroying ants, even just a single one, just for fun is not cool man.
