If you want to change the terms of the lease, then give him 30 days notice that you are going to do that.

Check with the local, provincial/state, and national regulations concerning rental agreements for rooms before you do anything. Make sure you fully understand these regulations.
Some areas limit increases to rent to a specific percentage. If 1/3 of your utilities are above the percentage they are paying, you can only increase the rent by that percentage.
Example:
Current rent = $400
If the allowed percentage of rent increase is 10% and your total utilities are $300 per month; then you can only raise the rent by $40 per month NOT by $100 per month.
So with the rent increase it will be $440 NOT $500 per month.

I have two roommates that are renting rooms in my home. They currently are on a month to month lease and pay 400 all utilities included. How long do I have to wait to charge them legally for 1/3rd of utilities. My one roommate is claiming he doesn't have to for 60 days but his current month to month agreement is all utilities included. Can I give him 30 days to amend his lease and then charge him 1/3rd of utilities or should I give him a 30 days notice to move out? He is not cooperating saying his rental agreement is utilities included. He has been living here for 3 months.
